More legal news about COVID-19 includes a California case against See’s Candies. A See’s employee initiated a wrongful death lawsuit against her employer. She claims that See’s did not provide a safe workplace, as required by OSHA.

As a result her husband contracted COVID and subsequently passed away. See’s stated that the employee’s claim should be a Worker’s Compensation claim and not a wrongful death lawsuit. The California Court of Appeals, however, sided with the employee and will permit her to maintain the wrongful death action on the allegation that See’s failed to ensure safety in the workplace.
