In the 2024 November election, Arizona voters approved a constitutional amendment (Proposition 139) which enshrines the right to an abortion up to the point of fetal viability. A vast majority – 61% – voted yes. Even though there are conflicting statutes still on the books, Attorney General Kris Mayes says the state may not interfere with the constitutional amendment. The amendment supersedes the statutes.
She further declares that she will not prosecute physicians who provide abortion care, but some have come forward saying they will wait and see, since the incompatible statutes are still in effect.
